The Ohio Medical Negligence Lawsuit

The Ohio wrongful death and medical negligence lawsuit alleges that the deceased victim was a resident of the nursing facility between November 2008 to April 12, 2009. During that time, a physical therapy assistant was walking the victim using a gait belt strapped around the victim’s waist to ensure the victim didn’t fall to the floor, as the victim was a high risk for falling. Despite the gait belt, the victim fell to the floor and suffered a broken hip and other injuries.

The Ohio medical negligence lawsuit claims that after the fall, Joe Doe #1 was called to the scene and that she and the physical therapy assistant, despite complaints of hip pain by the victim, negligently moved the victim from the floor to a wheelchair and then to a bed. The wrongful death and medical negligence lawsuit alleges that because of the victims injuries, and despite surgical treatment and attempted rehabilitation, the victim died from her injuries and related complications.

The Ohio wrongful death and Ohio medical negligence nursing home lawsuit alleges the defendants were negligent and fell below the accepted standards of medical care when they failed to exercise the degree to care required of reasonable skillful and prudent health care professionals under similar circumstances. The lawsuit alleges that the defendants failed to establish, implement, and train employees on an appropriate fall protocol and failed to properly implement that fall protocol when the victim fell. Because of these alleged negligent actions, the victim suffered severe injuries including a broken hip, spinal fractures, surgical procedures, hospital treatments, severe malnutrition, failure to thrive, chronic renal insufficiency, pressure ulcers, severe pain and disability, mental anguish, medical expenses, and loss of the enjoyment of life. The medical negligence and wrongful death lawsuit seeks damages exceeding $25,000 plus any relief the court deems just.
