Wright & Schulte is representing the family of a three-year-old autistic child who was assaulted last month by a Dayton Public Schools employee at Rosa Parks Early Learning Center. The entire incident, highlighted by NBC Nightly News on September 15, 2023, was caught on security cameras in the school’s hallways.
The child, who is non-verbal, is seen running through the hallway with a male employee chasing him. The video captures the employee grabbing the child by the head and throwing him to the ground, causing his head to violently strike the floor. The employee then grabbed the child by both ankles and carried him upside down through the hallway.
School officials informed the parents their child hit his head the day of the incident but did not give specific details about how the incident occurred. Three weeks after the incident, Child Protective Services informed the child’s parents of the assault and provided them with a copy of the security camera footage.
Dayton Public Schools stated they investigated the incident and announced that the employee is no longer employed with the school district. The Dayton Police Department is also investigating.
The child’s parents are speaking out in an effort to protect other students at the school. According to family attorney Michael Wright, they are contemplating their legal action.
